Arizona Rancher Who Shot Illegals in Self-Defense Vindicated at Trial

An Arizona judge declared a mistrial and then dismissed the charges in the case of George Alan Kelly, a rancher accused of fatally shooting Gabriel Cuen-Buitimea on his property near the U.S.-Mexico border.

After over two days of deliberation, the jury failed to reach a unanimous verdict. Superior Court Judge Thomas Fink announced the mistrial, noting the jury's inability to agree on any count.

The case involved Kelly, 75, who was charged with second-degree murder for the January 30, 2023, shooting. Kelly claimed he fired warning shots, but prosecutors argued he recklessly shot toward a group of men, including Cuen-Buitimea, from a distance of about 100 yards on his ranch.

Jurors visited the ranch and a section of the border as part of the trial proceedings.

Following the mistrial declaration, the Santa Cruz County Attorney’s Office had the option to retry Kelly or drop the charges. A status hearing was scheduled to decide the next steps. Consul General Marcos Moreno Baez of the Mexican consulate in Nogales, Arizona, awaited updates on the implications of the mistrial alongside Cuen-Buitimea’s family.

Kelly had previously declined a plea agreement that would have reduced his charge to negligent homicide. Additionally, he faced an aggravated assault charge related to another person in the group of migrants, who were not injured and returned to Mexico. Cuen-Buitimea had been deported from the U.S. several times, most recently in 2016.

In a subsequent ruling, Judge Fink dismissed the charges against Kelly with prejudice, meaning the case cannot be retried.
