Supreme Court Tosses Obstruction Charges For J6 Defendants

While we were all abuzz with the debate aftermath, SCOTUS slipped a huge victory through the wire: Its decision in Fischer vs. U.S.  stated that the “Department of Justice had taken too broad a view of [18 U.S.C.] 1512(c)(2), a law that prohibits the destruction of evidence but was not intended for protests.”

This means that the DOJ has essentially been rebuked by the country’s highest court for pursuing wrongful and unlawful charges and convictions against January 6 defendants.

It means mayhem for prosecutors as they await motions to adjust sentences for those still incarcerated on those charges.

It also, probably, means Special Counsel Jack Smith’s half of the four charges against former President Donald Trump pertaining to January 6th: obstruction of an official proceeding, conspiracy to obstruct an official proceeding, conspiracy to defraud the United States, and conspiracy against rights, will be dropped while Smith seeks a superseding indictment. 

Will those who were convicted of that charge sue the DOJ?

I would - especially once I heard the interview in which DOJ official Michael Sherwin somewhat admitted to the sham charges when he said, “Our office wanted to ensure that there was shock and awe….It worked because we saw through media posts that people were afraid to come back to D.C. because they’re, like, ‘If we go there, we’re gonna get charged,'” said Sherwin.

“We wanted to take out those individuals that essentially were thumbing their noses at the public for what they did.”

Add that to the fact that the DOJ could have charged defendants with an actual insurrection charge, (There is a federal insurrection statute, found at 18 U.S.C. 2383) but in most cases, did not. 

Today, the Supreme Court will also announce its decision on presidential immunity, just 10 days before Trump’s sentencing hearing.

Teen Daughter of American Still Held by Taliban Makes Emotional Plea for Her Dad’s Release

Ketsia Corbett graduated high school last week. Her dad was not there to cheer her on. In fact, her dad hasn’t been there at all for Ketsia, her mom, or her two younger siblings in the last two years - not because he doesn’t want to be, but because he is a prisoner of the Taliban who once again run rampant in Afghanistan since Biden turned the country back over to them. 

The Corbett family spent years in Afghanistan.

They were heavily involved in humanitarian work, and Ketsia’s dad, Ryan, ran a business to provide for his family as they dedicated themselves to helping the Afghan people.

The family returned to America after the disastrous fall, but Ryan later accepted an invitation to return. He felt responsible for the employees he left behind. He missed their friends and trusted in his safety since others had also returned with no issue. 

But for some reason, Ryan and a few others were detained. Ryan was held long after the others were released and remains a prisoner today.

His wife, Ana, was first told not to speak out, as any attention could hurt her husband’s cause. But now, over two years later, Ryan’s family has had enough of staying silent and trusting that Ryan will be brought home.

They are now publicly pleading for help, including a painful social media post last week by Ketia, who explained how excruciating the past two years have been, how scared they are for her father, and pleaded with Biden to bring her father home.

Kate Gibson is an international lawyer with extensive experience in high-profile cases. She is working to help free Ryan. In a recent interview, Gibson explained that last October, Roger Carstens, the Special Presidential Envoy for Hostage Affairs (SPEHA), officially designated Ryan as an American wrongfully detained abroad. That means, as per American foreign policy, that Ryan should be brought home.

Gibson also stated that she’s spent the last two decades working with detainees, and, “..it’s not an exaggeration to say I think Ryan’s case is probably the worst I’ve seen in terms of the inhumane conditions of his detention. I’m surprised he’s still alive, given what he’s enduring.”
